Terms of Service
1. Agreement
These Terms of Service (“Terms”) are an agreement between you and Top Cheddar LLC (“MoonScroll,” “we,” “us,” or “our”). They govern your use of moonscroll.ai, my.moonscroll.ai, api.moonscroll.com, and related services (the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. Content-rights requests are handled on our Copyright and Content Removal page. If you do not agree, do not use the Service.
MoonScroll is not affiliated with, endorsed by, or connected to Instagram, TikTok, YouTube, Meta Platforms, ByteDance, or Google, or their affiliates.
2. Eligibility
You must be at least 18 years old to use the Service. By using it, you confirm that you are 18 or older and that you have authority to bind yourself (and, if you use it for an organization, that organization) to these Terms.
3. The Service
MoonScroll is a software platform that analyzes publicly available short-form video and helps customers discover patterns, generate ideas and scripts, and (on some plans) generate videos.
We may change, suspend, or discontinue features. Insights, rankings, and generated output are provided for information and creative assistance only. They are not a guarantee of performance on any platform.
We may refuse, limit, or terminate access if we believe these Terms are being violated.
4. Accounts
You are responsible for your account, including keeping your login details secure and for activity under the account. Provide accurate information and keep it up to date.
If you invite others into a workspace, you are responsible for their use of the Service under your account.
5. Subscriptions and billing
Paid plans are billed through Stripe. Current plans and prices are on our pricing page. Some plans include a free trial. We do not collect or store full payment card numbers.
Subscriptions renew automatically until you cancel. You can cancel in account billing settings or via the Stripe customer portal. Cancellation stops future renewals. Fees already paid are not refunded unless required by law or we agree otherwise.
We may change prices. If you have a locked founding-member rate, that rate continues for as long as you stay subscribed, as described at signup. Otherwise, new rates apply at the next renewal after we post them.
Keep your billing email current so we can send receipts and notices.
6. Your content
You retain rights in content you submit or create in the Service, including brand materials, prompts, scripts, and videos you generate. You grant us a license to host, process, and display that content as needed to operate the Service for you, including through the service providers described in our Privacy Policy.
You represent that you have the rights to submit that content and that it does not infringe anyone else’s rights or violate the law.
If you send us feedback or suggestions, we may use them without restriction or compensation.
7. Public platform content
The Service shows and analyzes publicly available posts from platforms such as Instagram, YouTube, and TikTok. We do not claim ownership of that content. We do not host copies of those videos. We display them through the source platform’s embed and store metadata and derived analysis, as described in our Privacy Policy.
We rely on those platforms to enforce their own rules around adult, NSFW, and restricted content. We do not independently review every public video for that purpose. You agree you are 18 or older and that this content may appear in the Service.
Links and embeds go to third-party sites we do not control. Their terms and privacy practices apply to your use of those sites.
If you have rights in content shown in the Service and want it removed, see our Copyright and Content Removal page. We may remove or stop displaying public platform content at any time, including after a privacy or copyright request. That does not change your subscription or entitle you to a refund.
8. Acceptable use
You may not:
- Use the Service for anything illegal, or to violate copyright or other rights
- Try to access private or non-public social accounts or content through the Service
- Scrape, crawl, or resell the Service, or copy our data or product except as we allow
- Probe, disrupt, or bypass security, rate limits, or access controls
- Upload malware or interfere with other users
- Use the Service to harass people or to build advertising or surveillance profiles of individuals
- Misrepresent who you are, or submit content you do not have the right to use
We may suspend or terminate accounts that violate these rules.
9. Our intellectual property
MoonScroll, including the software, design, trademarks, and documentation, is owned by Top Cheddar LLC and its licensors. These Terms do not transfer any of that ownership to you. You may not copy, reverse engineer, or resell the Service without our written permission.
10. Privacy

11. Disclaimers
The Service is provided “as is” and “as available.” We do not warrant that it will be uninterrupted, error-free, or that insights or generated content will be accurate or meet your goals. Platform metrics, rankings, and recommendations can be incomplete or out of date.
To the fullest extent allowed by law, Top Cheddar LLC and its officers, employees, and providers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.
12. Indemnity
You will defend and indemnify Top Cheddar LLC against claims arising from your use of the Service, your content, or your violation of these Terms or of someone else’s rights, including reasonable attorneys’ fees.
13. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or close an account if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive (including intellectual property, disclaimers, liability limits, and indemnity) will survive.
14. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.
If a provision is unenforceable, the rest still applies. Our failure to enforce a provision is not a waiver. These Terms, plus the Privacy Policy, the Copyright and Content Removal page, and any plan-specific terms you accept at checkout, are the entire agreement between you and us for the Service.
15. Changes
We may update these Terms by posting a new version on this page and updating the date above. Continued use after a change means you accept the updated Terms.

17. Data Processing Addendum
For personal data you submit to the Service (account, workspace, and brand content), you are the controller and Top Cheddar LLC is the processor. We process that data only to provide the Service. We do not sell it.
Public platform data we collect ourselves is described in the Privacy Policy. We are the controller of that processing.
We use subprocessors needed to run the Service (hosting, email, analytics, payments, and AI providers). We remain responsible for them. We use reasonable security measures, will notify you of a personal data breach without undue delay, and will help with reasonable data-subject requests about data you control.
When your account ends, we delete or return that customer personal data except where law requires us to keep it. Data may be processed in the United States. This addendum lasts as long as you use the Service and is governed by Delaware law, like these Terms.
